debz1 im so sorry cant think of what else you can do.Can you throw her nice food from your apartment might make you feel better.Suppose the only way to get to her is over the brick wall,you must have thought of everything by now.

Let's be blunt here. Much as this might offend our British sensitivities, the way the dog is being treated is unlikely to be considered illegal in our own country. Why would we expect it to be illegal elsewhere?

As confirmed above, it has food, water, shade and enough tether to be able to move around. The earlier photo also clearly shows a dog with a coat in good condition. It shows no sign of being undernourished or kept in unsanitary conditions. Would that many British owners show as much care for their animal.

Is it unloved in the sense that we might love a house pet? Well, of course it is. But, if it’s a working dog as suggested earlier, why would anyone expect different?

I know the situation is very sad, however, there are no laws in the Balearics against the condition Dina is being kept in (each community has their own regulations and together with the Canaries, the Balearics are one of the best in Spain). The representative that went was Miguel (Martin's son in law) and he explianed that her leash is of an adequate length and that there was no excrement (so it seems the owners are cleaning the area). I work with Miguel and informed him about this thread which is why he went to visit Dina.

Actually Harters the dog is kept in very unsanitary conditions, amongst her own excrement for days on end. I can only think the owners must have cleaned it up prior to the visit. In addition although I said she was a hunting breed of dog I never suggested she was a working dog. Our main concern is she NEVER gets taken out of the small courtyard for work or recreation ..not EVER! In my book that's neglect. If she at least had a daily run the living conditions would be just about bearable.

The tether she has maybe with in the legal requirements but they often hook it up on a wall to about half its length ,so she is often on a very short leash. Often out of boredom she will push her water bowl around and it falls off the edge of the patio. Some friends who were staying at our apartment earlier this year were forever throwing ice cubes over the wall for her, to keep her hydrated.

I think if you saw her for yourself Harters ,as I do ,you would see she is undernourished...her ribs stick out. And yes I know that that sort of breed are naturally lean ,but that is when they are working...she never gets ANY exercise!! How can that be right?

When our Mallorcan friends came to visit they too were horrified when they saw her..so Sparky's right, not all Mallorcans are cruel to their animals, just as all British aren't oversensitive.

When you wrote, on 21/9, "She is a beautiful hunting dog", I assumed you meant she was a hunting dog.

As to how she looks and her environment, we can only judge from the photos you've posted - I don't see an undernourished dog or one with an out-of-condition coat, nor do I see an unsanitary yard that would indicate the dog is "amongst her excrement for days on end".

Call me an unsympathetic hard-hearted so-and-so, but I'm afraid I just don't see cruelty or neglect here. Although, one has to wonder why the family keep her if she's not a worker - clearly she isnt a housepet either. If I was them, I'd just get rid and save myself the hassle.

My Mallorcan brother-in-law tells me the main hunting season starts again tomorrow (1 October) - he's just been back to the island to renew his shooting licence - so it may be the dog will get some exercise if it is a hunter.

Either way, it seems that the owners are not in breach of the local law so, presumably, there is nothing more to be done.

It only goes to show, forums such as this can be a very powerful means of communication. Most of use them to chat etc. but there are other people reading what is said who can make a real difference to things.

The lady who runs the animal refuge went to this property today with the police to talk with the owner and it appears that the dog has gone. The say that found no trace of her and it looks like there was never a dog kept there. They have asked me if anyone in the forum knows where she has gone.

WHAT!! I can't believe that the people from the refuge eventually went after 4 months...I visited them back in June I'm also wondering why they finally went with the police when the representative who visited a few weeks ago said legally there was nothing wrong with Dina's living conditions?

'No trace of any animal ever being there'? That's ridiculous!! There's a metal ring on the wall where the tether was attached.They must have gone to the wrong house surely? Quelys do you know if the owners were there when they called?

I think the lady in the apartment above is in PP at the moment so I'll text her to see if she knows or has seen anything.

I text the lady in the apartment above us and she told me that Dina was there on Monday....on a 'short tether'. She said it was a Bank holiday and the children were at home. This is normally when Dina quote 'barks like crazy and gets excited to try and get their attention' , but apparently she was ' remarkably quiet'. She told me her sister is now there and she will report back to me in the morning. May I add I have never, before tonight, spoken to her about the dog, so these are her words.

This thread has now been running since April..although it has been over a year since I became aware of Dinas existence. Reading back through the posts I read that JMD40 said that the legal requirement for a tether should be two and a half times the dogs length AND the dog should be exercised twice a day. I wonder how when the 'representative' came a couple of weeks ago he surmised that she was being exercised? It's been our point since the start...not so much her living conditions(which are dire) but her quality of life

Hi Debz, as you state a representative from the refuge did go a few weeks ago to check on the situation (although legally they are unable to access private property and need the presence of a police officer). They have been waiting for the police to accompany them, which occurred yesterday. It is possible that they went to the wrong house. The owners were not there at the time. Someone from the refuge will return today and advise the police again if they see Dana.

The legal situation is that an animal should have a lead 2 and a half times their length (when the representative from the refuge went a few weeks ago she was tied to a cord from above and could move freely). The law does not state that a dog should be excercised twice a day.

I will let you know if I receive any more news

Hi Quelys, Thanks for your response. To access the property they would need to go to the road one up from Carrer de LLaut...something Bois? I think the house number is 6a but until I'm out there on the 27th I can't confirm the address. The best place to see Dina is over the wall by the swinmming pool in the apartment block...from there they would be able to see the entrance to their property.

Just to confirm she was definitely in the yard on Monday and I'm sure she must still be there . I can only think they went to the wrong house

The fact that the police are now involved implies they agree that she is being neglected!!

From what I hear of her circumstances and what I've seen at the sanctuary, it would be in her best interests to be "rescued" and taken to the animal sanctuary. She'd have a much better life there & would get a lot of love & attention, as well as lots of exercise. I hope that Josefina will be able to take her.

Linz , I agree about the sanctuary..when we visited in June we thought it was fantastic, and I'm sure Dina would be much happier living there. It's certainly not like Battersea Dogs home, as most of the smaller dogs are allowed to roam freely around the grounds. The bigger dogs are kept in large outdoor pens with kennels..but get taken for regular exercise!!

I've had it confirmed this evening that Dina IS still in the backyard...so whoever visited yesterday must have gone to the wrong house!

Hi Debs, Josefina did take the police to the wrong address and her representative does feel the same as you, however, they cannot take the law into their own hands. They must now wait for the police to return with them.

Fingers crossed at last something may be done. We are out on the 27th for two weeks and there's a drink with your name on it from me

If they do take her to the Sanctuary before I get to PP, I will be hot footing it there to hopefully properly meet her, instead of from a distance of 15ft peering over a 5ft wall!!
