What is the exact position about apartments in 2018

Using your profits to invest in updating your hotel is fine. But dramatically putting your prices up beacuse your rooms need a lick of white paint, I dont think thats fair. Especially on loyal customers who come to Pollensa more than once a year, every year.
 
I guess that the better the quality of the property, the higher rental income it can command. Fairly normal business practice it seems to me. If a hotel increases from a 3 star rating to a 5 star rating you would hardly expect the rack rate to remain unchanged.....even for loyal previous customers. The evils of capitalism! LOL

I wouldn't say the star ratings were going up, just bringing themselves into 2017.
Maybe I'm just looking too hard for reasons why the prices have increased so much. I'd prefer not to be in a hotel anyway. I want to be self catering, looking after myself, and taking in everything that Pollença has to offer!

I wouldnt have an issue with the tax, if it wasnt for the high price of accomodation in the first place.
And I wouldnt have an issue with the rental legislation, if they would hurry up and get it sorted! Waiting till july could destroy next summer.
 
Sparky normally Andrew is spot on but his comparison falls down when you know that in Croatia you can legally obtain a rental licence when you buy an apartment whereas in Mallorca you cannot even apply for at least another year.

In UK when concerns were raised in the 90's about passive smoking, especially after all the publicity about Roy Castles death after spending years in working men's clubs, smoking wasn't banned whilst they worked out a compromise solution but cross party support was agreed with the introduction of a ban on smoking in public places. I'm sure now that most would agree that the health of the nation improved as a result.

Whilst not on quite a grand scale, surely cross party support should have been established in creating legislation that at least maintained or more importantly improved the economic health of the island. Most agree that there should be more control over private rentals, with proper licensing, proof of payment of tax and restriction in certain over developed areas but we are now in no mans land.

What concerns me is that a minority in the parliament has managed to impose their extreme view before legislation is enacted. Any thoughts that they will now suddenly change their mind and compromise in the near future seems to be wishful thinking at best.

One can only hope that Madrid can sort this mess out before it becomes more of a farce. One business closed or one property repossessed is one too many for people struggling in an ever contracting season.

So I should wait for a wee while before trying to book a private apartment in the hope that the situation will change ?

Just back from a first visit to Tossa de Mar and was thoroughly impressed. Not noisy and lovely restaurant's. However my heart it still with PP but it seems to me that the powers in Majorca are not thinking this through at all. If we cannot get an apartment (need one now that sis is coming out with us again) I will need to reconsider our main holiday some where else.

All those restaurant's that we all use will not be able to be sustained by the no of hotel beds in the area. Please tell me common sense will prevail before too long.

p.s had to pay tourist tax in Tossa de Mar

I dont know whether or nor I am looking forward to our 2 weeks stay in the port next month. I enquired what the situation was in August immediately after the announcement of the new legislation and was told by the agent that there will be no problem (see earlier post). I've been in touch with the owner regarding key arrangements etc and she tells me that she has cancelled all the other rentals this year except ours because we had booked so early. But she has asked that if we are questioned by the neighbours/admin personnel to say that we are friends of the family and if we cannot agree to this, then she will have to cancel our rental - and at such short notice there is nothing we can do except agree to this. So I am now feeling very uncomfortable about the whole situation and hope that we do not meet with any hostility from the neighbours. Other problem is that the owner is foreign (not Spanish) and although I do speak a bit of schoolgirl 'language' and my husband doesnt speak a word of the language, I am now going to have to brush up. (I havent mentioned the nationality of the owner as I dont know who may be reading this - now just HOW paranoid is this!!)

As this will be a 'clandestine' rental we will have no backup in the port and if we have any problems we need to contact the owner - hundreds of miles away!

So this will sadly be our last stay in the port after nearly 25 years of October visits. We have a country villa booked for next summer but after that ............. who knows.:(
 
Rosie 34 I'm exactly the same re next year. I contacted the owner who said don't worry I need to pay my mortgage. Keep it quiet and all will be well, I don't think so. I've priced hotels etc as there are only the 2 of us, way to expensive with meals, drinks,tax, flights etc, I really can't justify the money it would take. So for us it's somewhere else next year, just looking for a PP in a different country, probably impossible.

Remember that you have done nothing wrong so I wouldn't lie to anyone in a position of authority just because a property owner says so.

Not wanting to frighten anyone but best not to incriminate yourself just because someone tells you to lie.

Anyone that has been involved in court proceedings will know it is an absolute nightmare for all involved so best not get involved just to try to help someone you don't even know, it is only a holiday and no one needs this worry and stress.

Hopefully you wont be asked about it and if so think carefully before answering as it is not your problem, just be honest.

The rental situation is a nightmare :(

If "large holiday companies" buy some of these will they still be under the same laws or if they become "aparthotels"would this be different like habitat or Duva? It might therefore become very expensive as would be hotels. I have been looking t accommodation at the beginning of the year(March) and some hotels are already fully booked

I have noticed that some of the habitat apartments have appeared for sale (with licence). I also noticed that the entire block of habitat apartments at the duva entrance (called them duvabitat, ran from the duva) is completely for sale! Very curious as to why they dont want them part of their aparthotels anymore!!!:confused:
 
Any property which has a license be it apart hotels tourist apartments or villas are now sought after and will continue to be. Anyone thinking of purchasing would be wise to buy something with a license even if the intention is not to rent out. A propery on sale will always have much more value with the option of renting with the excellent returns renting can bring.

Don't assume a property with a license will be ok as reading in the majorca bulletin this week the authorities are now revoking licenses on properties that hold a license when they feel they don't conform to the new rules that includes villas, apartments, etc.
 
I would advise against assuming everything you read in the MDB is correct.It was only last week that it was reported that sun beds and bars were to be banned on the beaches! There are many who just like to continue a panic situation. If you read Jan Dexter's post on Facebook you will be aware she actually attended the meeting held in Palma yesterday with the tourism minister. Those already holding a license or have one in application prior to to the cut off of July 1st 2017 are not of interest or worry and the old rules apply. It is those who have attempted to lodge an application after July 1st and have the application in waiting until the new law and tourist areas have been approved who will be considered under the new rules. The last thing anyone would want is more panic in a delicate situation so it is important for facts to be put forward and nothing else.

I think you will find that the MDB reported that Mes, the minority socialist party had "proposed" that sun beds should be banned not that they are to be banned.With only a small number of seats it would be very unlikely to be adopted.
 
Apologies - I left out the word proposed! The point being how ridiculous many a situation is at present in Mallorca and how delicate! How easy it might be to cause panic and for rumours to start. As I said on a previous post it is important to note facts. I went against this by admitting a word and putting a different emphasis on a situation.
