Sadly my mother passed away in Majorca in May. She banked with Santander and I was advised not to inform the bank immediately as they would freeze her account and it was a complicated process with the few remaining direct debits with Endesa etc and I would need to involve a notary. I had enough on my plate organising the funeral. I have her death certificate etc.

Can anybody advise me what I need to do to close her account, transfer the remaining funds and open one in my name in Majorca (I live in the UK but have owned the flat my mother lived in for several years). I am aware that what I am doing is not right, but I haven't been able to come to Majorca due to work commitments since May, but want to sort it properly by the end of the year.

Also, do I need to make a will in Spain now for the Spanish property?

Hi Jilly - when my father passed away and left me his property in PP I did everything through Tony de la Cruz, our solicitor in PP.

You will need to do everything legally through a solicitor and it will be necessary for you to visit PP as you will need to go to the Notary to sign all the relevant papers.

From memory the bank account was just transferred to my name.

You should make a will (not sure if you have to legally) as this will make things much easier later.

Hope this helps and I am sure others will be able to give you more details

Thank you for your advice.

Is there anything else I need to be aware of? anything that could come back and bite me? I am already paying non-resident wealth tax in the UK

many thanks
